1. About ReservAI

ReservAI is an AI-powered restaurant reservation service. When you request a reservation, our artificial intelligence assistant places a real phone call to the restaurant on your behalf, negotiates the booking, and reports the outcome back to you.

By creating an account or using ReservAI, you agree to these Terms of Service and our Privacy Policy.

2. Eligibility

You must be at least 16 years old to use ReservAI. By using the service, you represent that you meet this age requirement and have the legal capacity to agree to these terms.

3. Account Responsibilities

• You are responsible for maintaining the security of your account credentials.
• You must provide accurate and complete information when creating reservations (correct name, party size, date, time, and any special requests). ReservAI is not liable for incorrect bookings resulting from inaccurate information you provide.
• You must not create multiple accounts to abuse the free token system.
• You are responsible for all activity that occurs under your account.
• All reservations confirmed through your account are made on your behalf and at your explicit instruction. ReservAI acts solely as a technical intermediary — the reservation commitment is between you and the restaurant. You are responsible for honouring, modifying, or cancelling any confirmed reservation. Repeated no-shows or patterns of abuse may result in account suspension.

4. How the Service Works

• You provide reservation details through our chat interface (restaurant, date, time, party size, guest name).
• You explicitly confirm the reservation before any call is placed.
• Our AI calls the restaurant, identifies itself as an AI assistant when directly asked, and attempts to book the table.
• Each reservation attempt costs one token (free users start with 5 tokens; Pro subscribers have unlimited use).
• You receive the outcome via the app and email: confirmed, rejected, or needs review.
• The full call transcript is available for you to review.
• Call transcription: By requesting a reservation call, you consent to the conversation being transcribed for accuracy, quality assurance, and dispute resolution purposes. ReservAI does not retain audio recordings — only the text transcript of the conversation is stored. Transcripts are handled in accordance with our Privacy Policy.

5. AI Limitations & Disclaimer

ReservAI uses artificial intelligence, which has inherent limitations:

• No guarantee of success: We cannot guarantee that every reservation attempt will succeed. Restaurants may decline, be closed, be unreachable, or not understand the AI.
• AI may make mistakes: The AI may occasionally misunderstand restaurant responses, transcribe information incorrectly, or miscommunicate details. Always review your confirmation and the call transcript.
• Restaurant refusal: Some restaurants may decline to engage with AI callers or end the call without making a booking. This is outside our control and is not grounds for a refund beyond our standard token refund policy.
• Not a substitute for direct contact: For critical reservations (large parties, special events), we recommend also contacting the restaurant directly. The restaurant's phone number is always provided.
• Restaurant information: Restaurant details (phone numbers, addresses, hours) are sourced from Google Places and may occasionally be outdated or inaccurate.

6. Tokens & Payments

• New accounts receive 5 free tokens. Free tokens do not expire while your account remains active. Each reservation attempt consumes 1 token, regardless of the outcome.
• Additional tokens can be purchased in packs. Purchased tokens do not expire.
• ReservAI Pro ($14.99/month) provides unlimited reservation attempts for the subscription period. Pro subscriptions auto-renew monthly at the applicable rate until cancelled.
• Payments are processed securely via Google Play (Android) or Lemon Squeezy (web). We do not store your payment details.
• Token purchases are non-refundable. Pro subscriptions can be cancelled at any time; access continues until the end of the billing period.
• A token is consumed when the AI initiates the call, not when the reservation is confirmed. Failed or rejected calls still use one token.

7. Acceptable Use

You agree not to:

• Use the service to harass or spam restaurants with repeated fake reservations
• Provide false or misleading information in reservation requests
• Attempt to manipulate or inject prompts into the AI system
• Reverse-engineer, scrape, or exploit the service or its APIs
• Create reservations you have no intention of honoring
• Share your account with others or resell tokens
• Use automated tools or bots to interact with the service

Violation of these rules may result in account suspension or termination without refund.

8. Third-Party Services

ReservAI depends on third-party providers to deliver its service, including telephony providers, AI language model providers, text-to-speech services, restaurant data sources, payment processors, and push notification infrastructure. We are not liable for failures, outages, errors, delays, or interruptions caused by any third-party service. We do not endorse and are not responsible for the practices or content of any third-party provider.

9. Indemnification

You agree to indemnify, defend, and hold harmless ReservAI, its officers, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the service; (b) your violation of these Terms of Service; (c) any reservation made through your account; or (d) your infringement of any third-party right. This obligation survives termination of your account.

10. Force Majeure

ReservAI is not liable for any failure or delay in providing the service caused by circumstances beyond our reasonable control. This includes, but is not limited to, infrastructure outages, telephony provider failures, AI provider outages, regulatory changes affecting automated calling, natural disasters, or other events that make it impossible or impractical to operate the service. In such cases, we will make reasonable efforts to restore service as soon as practicable.

11. Limitation of Liability

ReservAI is provided "as is" without warranty of any kind. To the maximum extent permitted by applicable law:

• We are not liable for missed reservations, incorrect bookings, or any damages arising from AI errors during phone calls.
• We are not responsible for restaurant availability, quality, or service.
• Our total liability for any claim shall not exceed the amount you paid to ReservAI in the 12 months preceding the claim.
• We are not liable for indirect, incidental, consequential, or punitive damages.

These limitations do not affect your statutory rights under EU consumer protection law or other applicable mandatory legislation.

12. Intellectual Property

All content, design, code, and AI technology in ReservAI are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works from any part of the service without our written permission.

13. Account Termination

You may delete your account at any time by contacting us. We may suspend or terminate your account if you violate these terms, abuse the service, or engage in fraudulent activity. Upon termination, your data will be handled in accordance with our Privacy Policy.

14. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated date. If we make significant changes, we will notify you via email. Continued use of the service after changes constitutes acceptance of the updated terms.

15. Governing Law

These terms are governed by the laws of Romania and the European Union. Any disputes shall be resolved in the courts of Romania. Nothing in these terms limits your rights under mandatory EU consumer protection regulations.
